Bug Mars Data Use Agreement

This Data Agreement (“Agreement”) establishes the terms by which Data is gathered, stored, used, and shared with others when using Bug Mars products and services (collectively “Services”). “You” means the person or company that creates an account for use of the Services. “Company”, "We" or "Our" means Bug Mars Inc.

By using our Services, you are agreeing to these terms. Please read them carefully.

1. The Information We Collect

When using the Services, data may be collected and transmitted to the Company, including:

1. Farm Management Data. Financial, tax, employment, commodity price, regulatory compliance, supply chain, and other management data.
2. Machine Data. Telematics information, machine health, fuel consumption, load, use, and other machine performance data.
3. Climate and Weather Data. Precipitation, wind speed and direction, temperature, and other weather information.
4. Livestock Data. Animal or insect identification and pedigree, genetic and genomic information, feed consumption, and other data related to livestock.

The Company may derive, analyze, manipulate or combine data to create derivative data ("Derivative Data"). The Data may be aggregated with data from other users to create "Aggregated Data," which will not contain your personal information.

2. Ownership of Data

1. You own the Data that originates from your property or equipment.
2. Bug Mars owns all anonymized Aggregated and Derivative Data.

3. Usage of the Data

1. License Grant. You grant Bug Mars a royalty-free license to use, store, anonymize, and process your Data.
2. Third Parties. We may use third parties for processing, and they are bound by this Agreement.
3. Monetization. Aggregated and Derivative Data may be licensed to others.

4. Data Sharing with Third Parties

We may share Data with third-party experts such as entomologists, consultants, insurers, etc.

5. Government

We will notify you of any court-ordered request for Data. We are not liable for such disclosures.

6. Your Responsibilities

You are responsible for unauthorized access or misuse caused through your account. Upon termination, personal Data is deleted except where it has been anonymized or aggregated.

7. Modifications

We may revise this Agreement. Continued use constitutes acceptance of the new terms.

8. Security/Notice

We use customary security practices. You will be notified in the event of a breach.

9. Deletion

You may request deletion of Data. We will comply where feasible. Aggregated Data will not be deleted.

10. Sale of Company

This Agreement will transfer to a new owner in the event of acquisition or sale of Bug Mars.

11. Termination

This Agreement ends with your use of the Services. Some provisions survive termination.

12. Limits on Liability

We are not liable for loss or damages caused by data collection, breach, or acts beyond our control.
